Your claim of 4th amendment rights (i.e. warrantless searches) has nothing to do with issue at hand. 14th amendment rights (i.e. equal protection) may be at issue, but so far the courts haven’t agreed.
Using your arguments I could say that unmarried couples should receive equal protection. Or polygamous couples. Or underage couples. This is a gray area and, under our confederal system, the federal government should only get involved in clear-cur cases. The best place for gays to make their case is on a state-by-state basis.
